Earth and Ember — Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of the Earth and Ember website and your participation in all classes and services provided by Earth and Ember (“we”, “us”, “our”).

By accessing our website, booking a class, purchasing a membership, or participating in any service, you agree to be legally bound by these Terms.

1. Eligibility

• Clients must be at least 14 years of age to participate.

• Clients under 18 may only attend with the consent of a parent or legal guardian.

2. Single-Sex Services

• In accordance with the Equality Act 2010, Earth and Ember operates as a women-only studio.

• This provision exists to support wellbeing, comfort, and a calm, focused practice environment. Eligibility is determined by the studio and applied consistently across all services.

• All decisions made in the interest of safety, wellbeing, and group experience are final.

3. Health, Safety & Assumption of Risk

• Yoga, Pilates, Barre Fit, Barre-lates, Yoga-lates, Barre-inspired fitness, and other fusion fitness classes are physical activities that carry inherent risks.

• By booking and attending, clients confirm that they:

  • Are in suitable physical condition to participate

  • Have sought medical advice where appropriate

  • Voluntarily accept all risks associated with participation

  • Will follow instructor guidance, including recommended modifications, to minimise risk

• Participation is entirely at the client’s own risk.

• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or any liability that cannot be excluded under UK law.

4. Health Disclosure & Personal Responsibility

• Clients must disclose all relevant medical conditions, injuries, limitations, pregnancy status, or health concerns that may affect safe participation.

• Instructors are not medically qualified and rely on accurate disclosure. Failure to disclose relevant information may result in refusal of participation and invalidates liability claims to the fullest extent permitted by law.

• Clients are responsible for monitoring their own condition during classes and must stop immediately if they experience pain, dizziness, discomfort, or distress.

5. Pregnancy & Prenatal Participation

• Earth and Ember does not offer prenatal-specific classes.

• Clients who are pregnant, believe they may be pregnant, or are postpartum must inform the instructor before class and seek medical clearance where appropriate.

• Attendance during pregnancy is at the client’s own risk and may not be suitable in all circumstances.

• Earth and Ember accepts no liability for pregnancy-related complications except where liability cannot be excluded under UK law.

6. Studio Access & Appointments

• Earth and Ember operates on a strictly appointment-only basis.

• Studio access is limited to clients with a confirmed, pre-booked class or one-to-one session. Unscheduled visits, walk-ins, or in-person enquiries are not permitted.

• All enquiries, bookings, and communications must be made via the official website or app, Fit by Wix.

7. Bookings & Payments

• All sessions must be booked and paid for in advance via the website or app.

• Earth and Ember is a cashless studio. Payment is required at the time of booking.

• Un-booked drop-ins are not accepted.

• Prices are subject to change and will not affect confirmed bookings.

8. Cancellations, Late Arrivals & Refunds

• Booking Cut-Off: Bookings close 12 hours before the scheduled start time. Requests within this window may be considered at the studio’s discretion and are not guaranteed.

• Cancellations & Reschedules: Must be made at least 12 hours before class start time via the booking system or direct message. Social media comments or third-party requests will not be accepted.

• Late Cancellations & No-Shows: Late cancellations and no-shows result in forfeiture of the class credit or payment. No refunds, credits, or transfers will be issued. Repeated no-shows may result in cancellation of future bookings or booking restrictions.

• Late Arrivals: Clients must arrive on time. Entry may be refused once class has started for safety and disruption reasons. Late arrival may be recorded as a no-show at the instructor’s discretion.

• Waitlist: Waitlist places are offered at the discretion of the studio. To be added from the waitlist, clients must have an in-date class pack or active membership. Waitlist places must be confirmed within 1 hour or will be automatically released.

9. Client Responsibility

Clients are responsible for:

• Managing their own bookings and attendance

• Ensuring fitness to participate

• Providing accurate and timely health disclosures

• Following instructor guidance, studio etiquette, and all published policies

Non-compliance may result in restricted or suspended booking access at management’s discretion.

10. Class Participation & Conduct

• A confirmed booking and prepayment are required for entry to all sessions.

• Clients are expected to arrive prepared and respect the calm, focused environment of the studio.

• Disruptive behaviour, interruptions, or failure to follow class structure may result in refusal of entry or future bookings.

• The instructor reserves full discretion to limit or decline participation where necessary.

11. Right to Refuse Service

• Earth and Ember reserves the right to refuse entry, participation, or ongoing service where participation is deemed unsafe, disruptive, or inconsistent with studio policies.

• All such decisions are final.

12. Intellectual Property

• All content, branding, class materials, and media are the intellectual property of Earth and Ember and protected under UK copyright law.

• Unauthorised use or reproduction is prohibited.

13. Privacy

• Personal data is processed in accordance with UK GDPR and the Earth and Ember Privacy Policy.

14. Limitation of Liability

• To the maximum extent permitted by law, Earth and Ember accepts no liability for loss or damage to personal property, indirect or consequential losses, or technical issues preventing participation.

• This does not affect statutory rights.

15. Governing Law

• These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

16. Changes to These Terms

• Earth and Ember reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the revised Terms.
